New York compliance obligations

New York landlords commonly track 6 state and local compliance obligations, each listed below with its schedule, its sources, and the date we last verified it. Among them: check whether your New York LLC biennial statement is due, file annual HPD property registration by September 1 (New York City only), and pay or credit annual security deposit interest (6+ unit buildings).

Check whether your New York LLC biennial statement is due

If the property is held in an LLC formed in New York or authorized to do business there, the LLC must file a $9 biennial statement with the Department of State every two years in the calendar month its articles of organization or application for authority were filed, and a missed statement shows the company as past due in state records, which can block some business transactions.

File annual HPD property registration by September 1 (New York City only)

If the property is in New York City and is a building of three or more units, or a one-family or two-family home where neither the owner nor the owner's immediate family lives, it must be registered with HPD every year by September 1, or the owner faces HPD orders, civil penalties, and the loss of the right to go to court to recover possession for nonpayment of rent.

Pay or credit annual security deposit interest (6+ unit buildings)

In a New York building with six or more units, security deposits must earn interest in a New York bank account and that interest, minus an administrative fee of 1% of the deposit per year, belongs to the tenant, so settling it each year the way the tenant chose (paid out, credited toward rent, or held in trust until the lease ends) keeps the deposit in order and heads off disputes at move-out.

Pay the July 1 property tax installment (New York City only)

If the property is in New York City, property tax is due July 1 and January 1, plus October 1 and April 1 for properties assessed at $250,000 or less, and quarterly payers who pay after the 15th of the due month owe interest from the original due date, compounding daily.

Around July 1 · Last verified September 2026 · source 1 · source 2

Return security deposit with itemized statement within 14 days of move-out

New York landlords must return the security deposit within 14 days after the tenant moves out, with a written itemized statement of any amount kept for unpaid rent, damage beyond normal wear and tear, utility charges owed to the landlord, or moving and storing the tenant's belongings, and missing the deadline forfeits the right to keep any part of it, so send it by certified mail with a return receipt to prove the date.

Turn on heat for the October 1 heat season (New York City only)

If your property is in New York City, from October 1 through May 31 you must keep occupied apartments at 68F or warmer between 6am and 10pm whenever it is below 55F outside and at 62F or warmer between 10pm and 6am regardless of the outside temperature, or face HPD violations and daily civil penalties.

Stage snow and ice removal plan and supplies

Measurable snow usually reaches upstate New York between late October and mid-November, and cities such as New York City, Buffalo, Syracuse, and Albany require property owners to clear adjacent sidewalks within set times after snowfall, so lining up a snow contractor, shovels, and ice melt by the end of September avoids scrambling in the first storm and lowers the risk of slip-and-fall injuries and claims.
