Maine compliance obligations

Maine landlords commonly track 5 state and local compliance obligations, each listed below with its schedule, its sources, and the date we last verified it. Among them: file Maine LLC or corporation annual report by June 1, if your rental is in Portland, renew its city registration by January 1, and return security deposit with itemized statement within 21 days of move-out.

Confirm your town's first property tax due date and pay it on time

Each Maine city or town sets its own property tax due dates, and the first payment of the tax year usually falls between mid-August and mid-October, so confirm your town's date from its tax bill or website and pay by then, because an unpaid installment draws interest from the delinquency date your town sets (often the next day) and unpaid taxes can become a tax lien that forecloses after 18 months.

File Maine LLC or corporation annual report by June 1

If an LLC or corporation holds your rental, file its annual report with the Maine Secretary of State between January 1 and June 1 ($85, or $150 for an out-of-state entity registered in Maine), because a late report adds a $50 penalty and an entity that still has not filed can be administratively dissolved or, if formed out of state, lose its authority to do business in Maine.

If your rental is in Portland, renew its city registration by January 1

If your rental is in the City of Portland, renew each unit's long-term rental registration with the city by January 1 ($55 per unit a year, less up to $20 in eligible discounts), because a renewal received after January 15 costs a $50 per unit late fee, rising to $200 per unit after February 15, and renting an unregistered unit is a code violation.

Return security deposit with itemized statement within 21 days of move-out

Maine law (14 M.R.S. 6033 and 6034) requires returning the full deposit, or providing a written statement itemizing what is kept together with the balance, within 21 days after a tenancy at will ends and the unit is surrendered or within the time set in a written lease (never more than 30 days), and a landlord who misses the deadline forfeits the right to keep any of it and can owe double the amount wrongfully withheld plus attorney fees and court costs.

Verify smoke and CO detectors in all units

Maine law requires landlords to provide working smoke and carbon monoxide detectors at the start of each occupancy and to repair or replace them after a tenant's written notice, and checking every detector before each new tenant moves in, then again each year, keeps units safe and documents the pre-occupancy inspection that limits the landlord's liability under the statute.

Seasonal maintenance for Maine

Landlords in Maine plan upkeep around a cold climate: this guide lists 7 seasonal maintenance items for Maine in calendar order, each with its timing and the date we last verified it. Among them: monitor roof snow load and check for ice dams, smoke and CO detector seasonal test, and inspect foundation, drainage, and roof after spring thaw.

Monitor roof snow load and check for ice dams

Ice dams force meltwater under shingles and accumulated snow can stress roofs on older Maine buildings, so midwinter checks catch damage early.

Smoke and CO detector seasonal test

Inspect foundation, drainage, and roof after spring thaw

In most years the snow is off southern, coastal, and central Maine by mid-April, so a look at the roof, foundation, grading, and driveway then finds the cracks, heaves, and drainage problems winter left behind before spring rain and runoff reach the basement.

Complete pre-winter walkthrough and arrange snow removal

Trade guidance is to sign snow removal contracts before October 1 because the best contractors book up fast, and snow can reach northern Maine and the western mountains by late October, so arranging plowing now and checking weatherstripping, caulking, and attic insulation before the heating season keeps walks and driveways clear and holds down winter heating costs.

Winterize exterior plumbing and irrigation before first freeze

Hard freezes usually reach Maine's North Woods, Aroostook County, and western mountains between late September and mid-October, the Bangor area in mid-October, and southern Maine and the coast in late October or early November, and water left in hoses, hose bibs, irrigation lines, or plumbing in unheated spaces expands as it freezes and can crack the spigot or the pipe behind it, so draining and shutting off these lines by mid-September prevents burst pipes and water damage.
