Alabama compliance obligations

Alabama landlords commonly track 4 state and local compliance obligations, each listed below with its schedule, its sources, and the date we last verified it. Among them: check and file the Alabama Business Privilege Tax for your property LLC, pay Alabama property taxes by December 31 to avoid delinquency, and return security deposit with itemized statement within 60 days of move-out.

Check and file the Alabama Business Privilege Tax for your property LLC

An LLC that holds Alabama rental property must work out its Business Privilege Tax each year and, when the tax comes to more than $100, file and pay with the Alabama Department of Revenue by March 15 (April 15 for most single-member LLCs owned by an individual), because a late return costs a penalty of at least $50 plus interest.

Pay Alabama property taxes by December 31 to avoid delinquency

Alabama property taxes are due October 1 and become delinquent if not paid by December 31, after which unpaid bills add 12 percent annual interest and fees, and the property, or a tax lien on it, can be sold at a spring tax sale.

Return security deposit with itemized statement within 60 days of move-out

Alabama requires you to refund the deposit, or mail an itemized list of the amounts withheld with any balance, within 60 days after the tenancy ends and you get possession back, by first-class mail to the forwarding address the tenant gave in writing (without one, to the tenant's last known address, or failing that the rental's address), and a late refund or accounting costs double the original deposit, so send it by certified mail to prove the mailing date.

Test every smoke alarm and any CO alarms, and replace ones that fail

Alabama landlords must meet the building and housing codes that apply to the home and keep the electrical and other facilities they supply in safe working order, and the Alabama Fire College tells landlords to keep smoke alarms installed and working, so a yearly test that replaces any alarm that fails or is more than 10 years old protects occupants and documents that care.

Seasonal maintenance for Alabama

Landlords in Alabama plan upkeep around a humid climate: this guide lists 8 seasonal maintenance items for Alabama in calendar order, each with its timing and the date we last verified it. Among them: schedule annual termite inspection before spring swarm season, do spring severe-weather prep: trees, drains, and a shelter plan, and smoke and CO detector seasonal test.

Schedule annual termite inspection before spring swarm season

Subterranean termites cause the most structural termite damage nationwide and native eastern subterranean termites swarm from February to April, so an early February inspection for mud tubes and active infestations, plus fixing roof and plumbing leaks and moving wood away from the house, heads off damage, while properties in Mobile and Baldwin counties, where Formosan termites are most common, should also watch for evening swarms from April to July.

Do spring severe-weather prep: trees, drains, and a shelter plan

Alabama's peak tornado season runs from March to May, with the most tornadoes in April, so trimming dead limbs and branches near the house, clearing gutters and drains, and making sure occupants know the safest place to shelter (a basement, storm shelter, or small interior windowless room on the lowest floor) limits storm damage and keeps people safer when warnings come.

Smoke and CO detector seasonal test

An annual full test of smoke and CO detectors (beyond battery swaps) confirms every alarm actually sounds.

Service air conditioning systems before summer heat

An April tune-up that cleans the coils, checks the refrigerant, and clears the condensate drain gets the cooling system ready before Alabama's hot, humid summer, while contractors still have openings and before a midsummer breakdown leaves the home without cooling.

Complete hurricane season prep: roof, drainage, and flood insurance review

Atlantic hurricane season starts June 1, and hurricanes bring flooding rain and damaging wind well inland across Alabama, not only to the coast, so a May check of the roof, gutters, drains, trees, and loose outdoor items, plus a review of wind and flood coverage, leaves time for a new flood policy's usual 30-day wait.

Dehumidifier and mold inspection

Summer humidity drives mold growth; verifying dehumidification protects air quality and finishes.

Peak-season storm drainage and sump check

Confirming drainage and sump operation at peak hurricane season prevents flooding damage.

Winterize pipes and review fall severe-weather readiness

First freezes reach northeast Alabama by late October, most of the state in early to mid-November, and the coast in December, and a secondary tornado season runs from early November to mid-December, so protecting exposed pipes, draining outdoor hose bibs, and refreshing the household storm plan and weather radio batteries by mid-October helps prevent burst pipes and storm losses.
